Privacy Policy

Fontanna Młodości Sp. z o.o. with its registered office in Warsaw, providing services to natural persons, carrying out activities aimed at concluding agreements, concluding and performing agreements with these persons or with natural persons cooperating with them or acting on their behalf (“Clients”), protects the right to privacy and complies with legal provisions, including the Personal Data Protection Act of 10 May 2018, partly also on the basis of the Act of 29 August 1997, and Regulation (EU) 2016/679 of the European Parliament and of the Council (“GDPR”). This document constitutes the Privacy Policy.

1. General provisions

1.4 The Privacy Policy applies to all activities involving the Client.

2. Data processing principles and Client rights

2.1 Data may be processed for the following purposes:

  • Contractual purpose, Article 6(1)(b) GDPR — provision of services, activities prior to concluding an agreement, conclusion and performance of agreements, including e-commerce; failure to provide data makes performance impossible.
  • Direct marketing — based on legitimate interest, Article 6(1)(f) GDPR, or consent, Article 6(1)(a) GDPR, including analyses and profiling.
  • Preference research — legitimate interest, Article 6(1)(f), or consent.
  • Claims — establishment, pursuit or defence of rights, Article 6(1)(f).
  • Legal obligations — compliance with legal requirements, Article 6(1)(c).
  • Analyses/statistics — legitimate interest, Article 6(1)(f) – reporting, service development, statistical models.

2.2 Providing data is voluntary; consents — where required — specify the particular purpose.

2.3 The content of the required consents is provided when they are collected, with a sample included in the appendix “Sample Consent”.

2.4 The Controller applies appropriate organisational and technical measures; processors are verified in terms of security.

2.5 Data recipients:

  • companies affiliated with the Controller,
  • entities authorised by legal provisions, such as courts and authorities,
  • service providers: accounting, IT, marketing, communication/analytics, legal services, debt collection,
  • subcontractors and cooperating entities.

2.6 Data is not transferred outside the EEA.

2.7 Processing periods:

  • agreements/services — until claims become time-barred,
  • marketing/profiling — until the agreement ends or consent is withdrawn,
  • preference research — until the agreement ends or an objection/withdrawal of consent is submitted,
  • legal obligations — in accordance with periods specified by law,
  • claims — until limitation periods expire,
  • analyses/statistics — for the duration of the agreement and then until limitation periods expire.

2.8 Client rights:

  • withdrawal of consent, without affecting the lawfulness of previous processing,
  • objection to processing,
  • access to and copy of data,
  • rectification,
  • erasure,
  • restriction of processing,
  • data portability,
  • complaint to the Personal Data Protection Office.

2.9 Exercising rights: e-mail: info@e-fontanna.com.pl, by correspondence or in person at the Controller’s office. Identity verification is required before rights are exercised.

2.10 At the Client’s request, the Controller will provide information within 30 days on the scope of data, source, purpose, legal basis and recipients.

2.11 Data is protected against unauthorised access, disclosure, loss and alteration by organisational and technical security measures, including encryption.

3. Cookies

3.1 The Controller uses cookies for security purposes, high-quality service, website customisation and analysis of website usage.

3.2 Cookies are small text files stored in the browser on the end device. They contain the website name, validity period and a random browser identifier.

3.3 Consent to cookies may be given/withdrawn in the browser settings.

3.4 Disabling cookies may limit the functionality of the website.

Appendix: Sample Client Consent

  1. I declare that I wish to use the offer of Fontanna Młodości sp. z o.o. (…) for the purpose of concluding and performing an agreement, and I consent to the processing of my personal data for this purpose.
  2. I consent to the processing of my personal data by Fontanna Młodości Sp. z o.o. and cooperating entities — for the purpose of marketing products and services. Consent may be withdrawn at any time.
  3. I consent to receiving offers and commercial information by phone/SMS and electronically to the e-mail address provided, as well as through online services operated by the company.
  4. I consent to profiling — analysing and predicting my interest in products based on personal data and behaviour measurement. Consent may be withdrawn at any time.
